Client Registration Terms & Conditions

Please read the following carefully.

These Terms and Conditions apply to all sales, services, and operations provided by Niagara Dog Training Ltd. (“NDT”), their directors, employees, independent contractors, or any other person(s) providing Services on behalf of NDT (the “NDT Personnel”) to the legal dog owner (“Client”). The services provided by NDT include but are not limited to virtual and in-person private 1-to-1 dog training programs, group dog training programs, service dog training, therapy dog training and emotional support animal training, online dog training courses, pack walks and dog social activities (“Services”) as outlined in Schedule A. All Services are being provided for personal use only to the Client and not for commercial use in any way.


Declaration:

Dogs are animals and as such can be unpredictable and have the potential of displaying unwanted behaviours without warning. Working with dogs is not without risk to humans, other animals and material possessions.

Dogs are living creatures and their behaviours can naturally change over time due to factors such as age, changes in diet, changes in their environment and the fact that dogs are animals and can be erratic and unpredictable, and as such NDT does not provide any guarantees with respect to the Services provided by NDT.


The Client represents that they are the legal owner of the named pet dog that is requiring the Services herein; and the Client is aware that participation in any dog training Services may result in illness, accident, injury, death to Client or the dog. The Client agrees that they are aware of these risks and dangers and assume all responsibility for them and itself/herself/himself/themself. Clients remain responsible for their dogs at all times and are advised to ensure that they have adequate pet or household insurance coverage for liability in the unlikely event of damage or injury caused to their dog or caused by their dog to property or to a third party.


Niagara Dog Training reserves the right to refuse to provide service to a Client or their dog at its own discretion.

NDT does not guarantee the results of any of their Services and the Client acknowledges that any results will vary from dog to dog. Client acknowledges that NDT does not ensure or guarantee that the delivery of the Services will provide the results that the Client requested from NDT.


Payment and Refund Policy

Payment is required in full at the time of agreement to these Terms and Conditions and prior to the delivery of Services in accordance with Schedule A.

No refunds will be provided for any group classes after the first session as a spot in the group was held and cannot be replaced once the group programming has started.

NDT will refund the cost-per-session of any unused private training sessions, less a $50 processing fee plus HST and any transaction fees associated with receiving or returning monies to the Client. Cost of unused sessions can be held within the company as credit to be used towards other Services for a maximum period of 6 months from the date the Client completed payment for Services.

Additional Payment and Refund terms and conditions apply to Service Dog Training, Therapy Dog Training and Emotional Support Animal Training programs in accordance with Schedule B.


Release of Liability, Indemnity, Waiver & Assumption of Risk

By participating in one or multiple Services provided by NDT, the Client hereby acknowledges that the Client has voluntarily applied to participate in dog training Services with NDT, the Client is aware that there are inherent risks and hazards involved in activities with and around dogs and the Client is participating in these Services with knowledge of these potential risks. In order to participate in Services provided by NDT, its sole proprietor, trainers, employees, apprentices, independent contractors or NDT Personnel, the Client hereby agrees to the following:

(1) to assume all risks of such dog training Services, including any injury that may be caused (i) to the Client or Client’s dog by any other dog, person or NDT Personnel; (ii) to NDT Personnel, person, or any other dog by the Client or Client’s dog;

(2) to release NDT, NDT Personnel and any other people providing Services on behalf of NDT from any and all claims which the Client or the Client’s permitted assigns may have that may arise from the Services, including those relating to personal injury to the Client, Client’s dog(s), Client’s family or any other person(s);

(3) to indemnify, defend, and hold harmless NDT and NDT Personnel and any other people providing Services on behalf of NDT from all damage, loss, liability, claims or expense, whether arising from negligence or any other reason or cause whatsoever, including legal costs and lawyer’s fees, which result from any damage caused directly or indirectly by the Client, Client’s dogs or from other dog(s) participating in dog training Services;

(4) to ensure Client’s dog is in adequate health condition to participate in Services, is up to date on all necessary vaccinations, and that the Client will carry health records at all times during participation in Services;

(5) to acknowledge that NDT reserves the right to refuse to provide Services to a Client or their dog at its own discretion;

(6) to acknowledge that the Client is the legal owner of the named pet dog that is requiring the Services herein; and the Client is aware that participation in any dog training Services may result in illness, accident, injury, death to Client or the dog. The Client agrees that they are aware of these risks and dangers and assume all responsibility for them and itself/herself/himself/themself;

(7) to remain responsible for Client’s dog(s) at all times;

(8) to maintain adequate pet or household insurance coverage for liability in the unlikely event of damage or injury caused to Client’s dog(s), property, other dog(s), people or third party;

(9) to not hold NDT liable for any financial loss, loss of profit, or loss of opportunity as a result of participation in the Services provided by NDT;

(10) to allow NDT to use Client’s name, my dog's name and any photographs, sound and film recordings taken while receiving the Services of NDT; and

(11) to acknowledge and understand the additional terms, provisions and risks associated with participating in Service Dog Training, Therapy Dog Training and Emotional Support Animal Training Services as outlined in Schedule B of this Term and Conditions Agreement.


Schedule “A”

Services & Cost

This Schedule A outlines the Services provided by NDT, NDT Personnel or any other people providing Services on behalf of NDT, as well as the cost for Services required to be paid in full by the Client prior to delivery of Services.


Common Behaviour and Obedience Program (5 sessions for $727 + HST):

Private 1-to-1 (virtual and in-home) dog training sessions to assess and problem-solve common canine behaviour problems including but not limited to: barking; jumping; nipping/mouthing; hyperactivity; digging; crate training; and pulling on leash. This service can also cover obedience training methods and curriculum such as: heeling, sit, down, stay, and recall.


Puppy Training Program (5 sessions for $727 + HST):

Private 1-to-1 (virtual and in-home) dog training sessions. Education and training including but not limited to: raising a puppy; stages of puppy development; developing positive habits and behaviour; planning for socialization; implementing structure and obedience; and reviewing and problem solving essential puppy fundamentals and behaviours including but not limited to: housebreaking, crate training; mouthing/nipping, jumping, counter surfing, chewing/destruction, and introductory obedience and leash work.


Puppy Group Classes (6 sessions for $347 + HST):

Trainer-led puppy training classes with multiple dog owners/handlers and their puppies in a group, focusing on structured socialization, puppy training fundamentals, solutions to common puppy behaviour concerns, and introductory obedience training curriculum.


Obedience Group Classes

(Level 1 Basic Obedience 6-weeks for $347 + HST; Level 2 Advanced Obedience 6-weeks for $347 + HST):

Trainer-led on-leash dog training classes with multiple dog owners/handlers and their canines in a group environment, covering evidence-based dog training fundamentals, solutions to common canine behaviour concerns, structured socialization and obedience training. Level 1 Basic Obedience Group Classes focus on commands including but not limited to: sit; down; stay; heel; sit-stay; down-stay, release and come/recall. Level 2 Advanced Obedience Group Classes focus on commands including but not limited to: place; finish; here; look; advanced use of previous Level 1 commands; and use of long lines and hand signals.


Separation Anxiety Program (Virtual - 2 sessions for $229 + HST; In-home - 2 sessions for $329 + HST):

Private 1-to-1 training program focusing on assessing the causes and contributing factors of canine separation anxiety.


Intensive Behaviour Modification Assessment Consultation (1 session for $197 + HST):

Assessment of and brief intervention for problematic behaviour in canines, including but not limited to: barking; jumping; aggression; reactivity to dogs, people or children; separation anxiety; fear/phobias; running away; dominance; possessiveness or resource guarding; and rescue dog rehabilitation and integration.


Intensive Behaviour Modification Program (5 sessions for $727 + HST):

Includes the Intensive Behaviour Modification Assessment Consultation and 4 follow up training sessions focusing on the assessment of and intervention for problematic behaviour in canines, including but not limited to: barking; jumping; aggression; reactivity to dogs, people or children, separation anxiety; fear/phobias; running away; dominance; possessiveness or resource guarding; hyperactivity; digging; crate training; and pulling on leash and rescue dog rehabilitation and integration.


Service Dog Training, Therapy Dog Training and Emotional Support Animal Training Programs (Customized programming and cost ranging from $2,800 - $15,000 + HST):

Consultation, curriculum planning, and canine behaviour and obedience training specific to trainer-assisted service dog training, therapy dog training, or emotional support animal training for Client’s personal use. Services vary depending on Client’s dog, area of interest and personal uses of Client’s dog.


Pack Walk Socials: Group handler/dog walk with the purpose of on-leash exercise and structured socialization for canines and humans. Organization and facilitation of dog community members gathering in public locations with the goal of strengthening human-canine relationships. No formal dog training services provided.


Schedule “B”

Service Dog Training, Therapy Dog Training, & Emotional Support Animal Training

Service Dog Training, Therapy Dog Training and Emotional Support Animal Training Services are longer term services that require greater financial and time commitments with unique risks and provisions in addition to those outlined throughout this Terms and Conditions Agreement.


In order to participate in Service Dog Training, Therapy Dog Training and Emotional Support Animal Training Services provided by NDT or NDT Personnel, the Client hereby agrees to the following:

(1) to acknowledge that NDT provides training Services only and it is the responsibility of the Client to consult, seek approval and obtain documentation as needed from the respective health care professional for Client’s personal use of a Service Dog, Therapy Dog, or Emotional Support Animal. NDT is not responsible for medical advice or documentation for the Client or Client’s dog;

(2) to acknowledge that it is the responsibility of the Client for any certification of the Client’s dog(s) as a Service Dog, Therapy Dog, or Emotional Support Animal. NDT is not responsible for the certification of Client’s dog(s) as Service Dog, Therapy Dog, or Emotional Support Animal;

(3) to acknowledge that the Client is responsible for compliance with any legal regulations or requirements for the use of a Service Dog, Therapy Dog, or Emotional Support Animal;

(4) to acknowledge that there will be no refunds for Service Dog Training, Therapy Dog Training or Emotional Support Animal Training Services once the respective Stage of Services has commenced. Cost of unused sessions can be held within the company as credit to be used towards other training Services.


NDT reserves the right to update these Terms and Conditions at any time by notice and with immediate effect.

Should NDT waive any of these terms on an individual basis, the validity of the remaining clauses shall not be affected and NDT shall not be obligated to waive the same clause or other clauses on any other occasion.

Receiving or participating in any of the Services provided by NDT, shall result in automatic acknowledgement and acceptance of these Terms and Conditions.

These Terms and Conditions are deemed accepted and signed once the information below is completed and submitted.
